TERMS OF USE

Please read these Terms and Conditions carefully before participating in the program.

General

  • The program is designed to promote single-use waste reduction by means of reusability in Hong Kong.
  • The program is designed to create a circular economy for reusable tableware, reducing the environmental impact of single-use disposables.
  • The program is open to all customers in Hong Kong, including both local residents and foreign visitors.
  • The reusable tableware is provided for customers to carry to restaurants and use for their takeaway orders, replacing single-use disposable containers and cutlery, in order to cut down on waste.

Definitions

  • In this Terms and Conditions, the following words and expressions have the following meanings, unless otherwise defined or the context otherwise requires:
  • “Reusable tableware” means durable, washable, returnable containers and cutlery set that can be used multiple times.
  • “Cutlery set” means a case with stainless steel fork, spoon, and knife inclusive
  • “Vending Machines” means automated machines that dispense reusable tableware with refundable deposit required.
  • “Return Stations” means designated drop-off points/ RVM where customers can return their loaned reusable tableware with good condition, and redeem their refundable deposit by means of Octopus Card.

Except where the context otherwise requires, words importing the singular shall include the plural and vice versa; words importing a gender shall include all other genders; references to any person shall include any individual, firm, body corporate or unincorporate (wherever established or incorporated).

Tableware Ownership and User Conduct:

  • ·The reusable tableware provided through this program are the property of the program provider.
  • ·Customers must handle the reusable tableware with care and use them only for their intended purpose after rental.
  • ·Customers are responsible for the proper use and keep them in good condition during use.
  • ·Customers are prohibited from altering, damaging, or misusing the reusable containers in any way.
  • Customers are agree to return the containers in good, clean condition when finished using them.
  • Failure to comply with the user conduct guidelines may result in suspension or termination of the customer’s participation in the program.
  • All reusable tableware must be circulated within Hong Kong.

Tableware Rental Process and Deposit:

  • Vending machines within this program are the only channel for customers to rent reusable tableware.
  • Each customer is allowed to rent reusable items per account, which can be a combination of reusable container(s) and cutlery set(s), loaned items are recommended to return for reuse.
  • You can rent the reusable tableware from our designated vending machines using various payment methods, including Octopus card, credit/debit cards, mobile payments, and other contactless payment options shown on the kiosk.
  • The deposit amount will be clearly communicated at the kiosk prior to tableware pickup.
  • A refundable deposit of HKD $20 will be charged for each item customer rents.
  • Your deposit will be fully refunded on your OCTOPUS CARD upon the return of the item in acceptable condition at the designated return stations.

Tableware Return and Deposit Refund:

  • All loaned tableware must be returned to the designated drop-off station(s) within the program area and in a timely manner.
  • Loaned tableware can only be returned and accepted during operating hours of the return locations.
  • Each return station in this program has different operating hours, stations within non-operating hours will not accept any loaned tableware.
  • Containers should be rinsed and free of any food waste or residues prior to return.
  • Returned containers should be free of any visible damage or defects.
  • To receive your deposit refund, you must return the loaned tableware using your Octopus card. Refunds are not available through any other payment methods at the return station(s).
  • No other payment methods are accepted for returns and refunds at the return station(s), except Octopus card.
  • For customer(s) without Octopus card, they are recommended to visit a designated office in Wan Chai. For details on the deposit refund process, please refer to www.todi.com.hk.
  • Failure to return tableware within the specified timeframe or in acceptable condition, using a non-Octopus payment method may result in the forfeiture of your deposit at the return stations.
  • Containers that are cracked, broken, or excessively worn will not be accepted for refund.

Vandalism

  • Customers are responsible for the reusable containers they rent and must handle them with care.
  • Customers are strictly prohibited from vandalizing, defacing, or intentionally damaging any of the reusable containers or associated program equipment, such as vending machines or return stations.
  • Any act of vandalism or deliberate damage to the program’s property will result in the forfeiture of the customer’s deposit and may lead to legal action and potential prosecution.
  • The program provider reserves the right to ban customers from further participation in the program if they are found to be engaged in acts of vandalism.
  • Repeated incidents of vandalism or misuse of the reusable tableware may result in the suspension or termination of the customer’s participation in the program.
  • The program provider reserves the right to take legal action against customers for any intentional damage or misuse of the reusable tableware.
  • In case of any disputes, the program provider reserves the right to make the final decision.

Payment Currency

  • The refundable deposit for the reusable tableware is denominated in Hong Kong dollars (HKD).
  • Refunds of the deposit will also be provided in Hong Kong dollars.
  • The program does not accept payments in any other currencies at this time.

Rental Period:

  • There is no allotted return period for the reusable tableware.
  • However, all loaned tableware must be returned before the program ends/ within 30 days after the program ends. The program end date will be communicated to all customers in advance.
  • Failure to return the loaned items by the program end date may result in the forfeiture of your deposit.

App Account

  • Customers must download the program’s mobile app and register as a member in order to participate in the program.
  • Customers can create an account in the program’s mobile app to track their rental history, manage their deposits, and receive updates about the program.
  • To create an account, customers must provide accurate personal information, such as their name and other contact details.
  • Customers are responsible for maintaining the security of their account credentials and must not share them with any unauthorized third parties.
  • The program provider reserves the right to suspend or terminate a customer’s account if it is used for unauthorized or illegal activities.
  • Customers can use their app account to rent and return reusable containers, as well as receive notifications about the program’s updates and promotions.
  • The program provider may collect additional data from customers’ app usage, such as location information and usage patterns, to improve the program’s services. This data will be handled in accordance with the program’s data privacy policies.

Payment Methods

  • Customers can pay the refundable deposit at the designated vending machine(s) using Octopus Card, credit cards, or other contactless payment(s) shown on the kiosk.
  • Refund via Octopus Card is the only way for customers to receive their refundable deposit at the designated return stations within the program.
  • The program provider reserves the right to add, remove, or modify the accepted payment methods at any time.
  • Customers are responsible for ensuring their chosen payment method is valid and has sufficient amount to cover the deposit.
  • Failure to make the required deposit payment may result in customers being unable to rent the reusable containers.

Hygiene

  • The program provider has partnered with a designated washing workshop that will take full responsibility for the cleaning and sanitization of all returned reusable tableware.
  • The washing workshop will use commercial-grade dishwashing equipment and sanitizing procedures to ensure the reusable containers meet the highest hygiene standards before being redistributed.
  • Customers are encouraged to remove all residues and rinse tableware before return, however it is not required to wash the containers themselves, as the washing workshop will handle this process.
  • Permitted Use and Restrictions
  • The reusable containers are not permitted to be used outside of the designated program area within Hong Kong.
  • Containers may not be reused for any purpose other than what was originally intended.
  • Customers are prohibited from using the reusable containers for any purpose other than the intended food or beverage consumption.
  • Customers are prohibited from using the reusable containers for any illegal, unethical, or harmful activities.
  • Tampering with, modifying, or attempting to resell the containers is STRICTLY PROHIBITED.
  • Customers are not allowed to remove the containers from the program’s designated return locations or vending machines.
  • Customers are prohibited from transferring, selling, or trading the rented containers to other individuals or entities.
  • Customers who misuse the reusable containers or the program’s platform may be subject to suspension or termination from the program.
  • The program provider reserves the right to limit the number of containers that can be rented by a single customer at any given time.
  • Customers who violate these restrictions may face suspension or termination from the program, forfeiture of their deposits, and potential legal action.

Maintenance Arrangement

  • ·The program provider will regularly maintain and service the vending machines and related infrastructure.
  • The program provider will make reasonable efforts to minimize disruptions and provide advance notice of any planned maintenance.
  • Customers may experience temporary unavailability of the vending machines and return stations during maintenance periods.

Intellectual Property Rights

  • ·All intellectual property rights, including trademarks, logos, and designs associated with the program are owned by the program provider.
  • Customers are not permitted to use, reproduce, or distribute any of the program’s intellectual property without prior written consent.

Copyright

  • The content, design, and all intellectual property rights associated with the reusable container program are owned by the program provider and are protected by copyright laws.
  • Customers are not permitted to reproduce, distribute, or modify any part of the program materials without the prior written consent of the program provider.
  • The program provider reserves all rights in the compilation of the content, software, and other materials related to the reusable container program.

Disclaimer

  • The program provider is not responsible for any loss, damage, or theft of reusable tableware.
  • The program provider reserves the right to update, modify, remove any content or information, suspend or terminate the program at any time without prior notice.
  • Customers are responsible for following all applicable laws, regulations, and guidelines related to the use and handling of the reusable tableware.
  • The information provided in this program is for general educational and informational purposes only.
  • The program provider does not guarantee the accuracy, completeness, or timeliness of the information presented.
  • Customers are advised to consult with relevant professionals or authorities for specific advice or guidance related to the use of the reusable containers or any other matters.

User-generated Content

  • The program may allow customers to share user-generated content, such as reviews, feedback, or comments.
  • The program provider does not endorse or verify the accuracy of any user-generated content and is not responsible for its content or consequences.
  • User-generated content reflects the views and opinions of the individual users and may not represent the views of the program provider.
  • The program provider reserves the right to monitor, edit, or remove any user-generated content that it deems inappropriate, offensive, or in violation of the program’s terms and conditions.
  • Customers are solely responsible for the content they generate and share within the program.

Data Privacy

  • The program provider is committed to protecting the privacy of our customers.
  • Any personal information collected through the rental process will be handled in accordance with our Privacy Policy, which can be found on our website.
  • The program provider will handle all customer data in accordance with applicable data privacy laws and regulations.
  • The program provider collects and processes certain personal information from customers, such as name, contact details, and rental history, to administer the program.
  • Customer data will be used only for the purposes of the reusable container program and will not be shared with third parties without the customer’s consent, except as required by law.
  • The program provider does not share or sell customer data to third parties. Your personal information will only be used for the purposes of administering the Reusable Container “Reuse and Return” Program.
  • Customers have the right to access, update, or delete their personal information at any time.
  • The program provider takes reasonable measures to protect customer data from unauthorized access, loss, or misuse.
  • Customers agree to the collection and processing of their personal data for the purpose of administering the reusable container program.

Reporting Issues or Concerns

If you encounter any problems or have feedback about the reusable container program, we encourage you to let us know right away. There are a few ways you can report issues or concerns:

1. Speak to a staff member at the return station/ nearby concierge

  • ·Staff on-site or at the concierge will be able to assist you directly with any immediate issues, including but not limited to damaged or missing containers, problems with the return process.

We take all feedback and reported issues very seriously. Our goal is to continuously improve the reusable container program based on user experiences. All reports and feedbacks will be reviewed, and we will work to address any problems in a timely manner.

Prevailing Language

  • These Terms and Conditions are provided in both English and Traditional Chinese.
  • In the event of any discrepancy or inconsistency between the English and Chinese versions, the English version shall prevail.

Program Changes:

  • The program provider reserves the right to modify these terms and conditions of the program at any time with reasonable notice to customers.
  • Changes will be communicated to all active program customers.
